Welcome to ZIORA. The terms “we”, “us” and “our” refer to ZIORA. We operate this website and online store (the “Services”) and provide related information, content, features, tools, products and services to you, the customer. Our store is powered by Shopify.
These Terms of Service (the “Terms”), together with any policies referenced here (including our Privacy Policy and Refund Policy), describe your rights and responsibilities when using the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, please do not use the Services.
1. ACCESS AND ACCOUNT
By using the Services, you confirm you are at least the age of majority in your country/region of residence and have consent to allow any minor dependents to use the Services on devices you own or manage.
You may be asked to provide information (e.g., email, billing, payment and shipping details). You warrant such information is true, current and complete and that you have the right to provide it.
You are responsible for safeguarding your account credentials and for all activity under your account. You may not transfer, sell or assign your account.
2. OUR PRODUCTS
We try to display products as accurately as possible; however, colours and appearance can vary by device and settings. We do not warrant that products will meet your expectations or exactly match images.
Product descriptions, pricing and availability may change at any time. We may limit quantities or discontinue products at our discretion, including by person, region or jurisdiction.
3. ORDERS
When you place an order, you make an offer to purchase. ZIORA/EMPORIAMART LTD may accept or decline your order at its discretion. Your order is accepted only when we confirm acceptance and receive your payment.
Please review your order carefully before submitting; we may be unable to cancel after acceptance. If we do not accept, change, or cancel an order, we will attempt to notify you at the email and/or billing address provided.
Your purchases are subject to our Refund Policy [LINK]. You warrant purchases are for personal/household use and not for resale or export.
4. PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price charged is the price at the time of order and will be set out in your order confirmation email. Unless stated, prices exclude taxes, duties, shipping and handling.
You agree to provide current and accurate purchase and account information and to update it as needed so we can complete transactions and contact you.
You represent that (i) card details are true and complete; (ii) you are authorised to use the card; (iii) charges will be honoured by your card issuer; and (iv) you will pay all charges including taxes, duties, shipping and handling.
5. SHIPPING AND DELIVERY
Dispatch and delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs or events beyond our control. Title and risk of loss pass to you when goods are handed to the carrier. See our Shipping Policy [LINK] for details.
6. INTELLECTUAL PROPERTY
All content and materials within the Services (including trademarks, text, images, graphics, video, audio, design and layout) are owned by EMPORIAMART LTD, its affiliates or licensors and are protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes only. No licence or right is granted except as expressly set out in these Terms. “ZIORA” and related marks are trademarks of EMPORIAMART LTD. “Shopify” and related marks are trademarks of Shopify.
7. OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available” without warranties. Your use is at your own risk and subject to the third party’s terms. We may introduce new features or tools in future; such features are also subject to these Terms.
8. THIRD-PARTY LINKS
Our Services may contain links to third-party sites or materials. We are not responsible for their content, accuracy, policies or practices and are not liable for any damages relating to your use of them. Review third-party terms and policies before engaging in any transaction.
9. RELATIONSHIP WITH SHOPIFY
Powered by Shopify. Purchases you make are with EMPORIAMART LTD. Shopify is not a party to your transactions and is not responsible for any sales between you and us. You expressly release Shopify and its affiliates from claims arising from your purchases with us.
10. PRIVACY
Personal information is handled in accordance with our Privacy Policy [LINK]. Because our store is hosted by Shopify, certain personal data is processed by Shopify in order to provide and improve the Services; see Shopify’s Privacy Policy. Information may be transferred to and processed in countries outside your residence as described in our Privacy Policy.
11. FEEDBACK & REVIEWS
If you submit reviews, ideas or suggestions (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free licence to use and display the Feedback for any purpose, including commercial use. You warrant you have the rights to submit the Feedback and that it complies with these Terms. We may monitor, edit or remove Feedback at our discretion.
12. ERRORS & OMISSIONS
From time to time there may be errors or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct and to cancel orders based on inaccurate information (including after submission).
13. PROHIBITED USES
You may use the Services only for lawful purposes and in accordance with these Terms. Prohibited uses include, without limitation: violating laws; infringing IP rights; harassing or defaming others; transmitting malware; scraping; sending spam; impersonation; attempting to circumvent security; or any conduct that harms us, Shopify or other users. We may suspend or terminate accounts for violations.
14. TERMINATION
We may terminate or suspend the Services or your access at any time without notice. You remain liable for amounts due up to the termination date. Sections that by nature should survive termination will do so (including IP, Feedback, Disclaimers, Liability, Indemnity, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy).
15. DISCLAIMER OF WARRANTIES
Except as expressly stated by us, the Services and products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure or error-free. Some jurisdictions do not allow disclaimers of implied warranties; in such case, applicable law may apply.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, EMPORIAMART LTD, its officers, employees, agents, affiliates, contractors, service providers and licensors (and Shopify and its affiliates) shall not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, savings, data, or replacement costs, arising from your use of the Services or products, even if advised of the possibility of such damages.
17. INDEMNIFICATION
You agree to indemnify, defend and hold harmless EMPORIAMART LTD, Shopify and their respective affiliates, officers, directors, employees, agents, contractors, licensors and service providers from claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.
18. SEVERABILITY
If any provision of these Terms is held unlawful or unenforceable, such provision will be enforced to the maximum extent permitted and the remainder will continue in full force.
19. WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right under these Terms is not a waiver. These Terms and policies referenced herein constitute the entire agreement between you and us and supersede prior agreements relating to the Services.
20. ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
21. GOVERNING LAW
These Terms and any disputes or claims (including non-contractual disputes or claims) are governed by the laws of England and Wales. You and EMPORIAMART LTD agree to the exclusive jurisdiction of the courts of England and Wales, with venue in London.

Headings are for convenience only and do not affect interpretation.
23. CHANGES TO THESE TERMS
We may update these Terms from time to time. The latest version will be posted on this page, and material changes will be notified in accordance with applicable law. Your continued use of the Services after changes constitutes acceptance.
